TERMS AND CONDITIONS FOR THE USE OF THE LEEP JOB PORTAL
Labour Employment and Empowerment Programme (LEEP)
1. INTRODUCTION
These Terms and Conditions ("Terms") govern the use of the LEEP Job Portal, an initiative under the Labour Employment and Empowerment Programme (LEEP), managed by the Federal Ministry of Labour and Employment (FMLE) in partnership with Sapphital Limited. By accessing or using the Portal, users agree to be bound by these Terms.
2. DEFINITIONS
"Portal or Platform" refers to the Job Portal under LEEP in any name it will be called.
"User" means any individual or organization accessing or using the Portal.
"Employer" means a verified organization or individual posting job opportunities.
"Job Seeker or Candidate" refers to individuals registered to search and apply for jobs.
"Administrator" refers to the authorized operators (FMLE and Sapphital) managing the Portal.
3. ELIGIBILITY
To use the Portal:
- Job Seekers must be at least 18 years old.
- Job Seekers must be Nigerians.
- Employers must be duly registered companies in Nigeria or anywhere in the world, with valid evidence of registration and contact details.
- Use of the platform must comply with Nigerian law and applicable labour regulations.
4. USER RESPONSIBILITIES
For Job Seekers:
- Provide accurate, complete, and up-to-date personal and professional information, including qualifications, experience, and availability.
- Use the platform ethically and lawfully, and refrain from misrepresenting qualifications or applying for jobs dishonestly.
- Maintain the confidentiality of login credentials and report any suspected unauthorized access immediately.
- Respect communication etiquette when interacting with employers or platform support.
- Ensure timely updates of employment status and participation in interviews, training, or job-matching activities arranged via the platform.
For Employers:
- Post only legitimate, clearly defined, and verifiable job opportunities with accurate descriptions, qualifications, and application processes.
- Avoid any form of bias, discrimination, exploitation, misleading job advertisements, or any unethical employment practices.
- Provide prompt and professional feedback to candidates within a reasonable timeframe.
- Respond transparently to queries from administrators and participate in platform-led job fairs or recruitment events.
- Maintain valid corporate registration and ensure all company representatives using the platform adhere to platform rules and labour laws.
- Keep the portal updated with the status of all recruitment activities, including shortlisting, interview stages, offers made, candidates hired, and candidates rejected, in order to ensure transparency, accurate data tracking, and proper documentation.
- Must not misuse or abuse the personal or professional details of candidates accessed through the platform during or after the recruitment process. All information should be treated with confidentiality and solely used for legitimate hiring purposes.
- Agree to hold FMLE and Sapphital harmless in the event of any legal dispute arising from their hiring or recruitment actions, job postings, or candidate interactions.
5. ADMINISTRATOR RESPONSIBILITIES
- Ensure the platform remains functional, secure, and accessible.
- Use its best efforts to verify employer registrations and job postings
- Provide user support and guidance through approved channels.
- Maintain data privacy and compliance with applicable laws.
Employers are solely responsible for the integrity and accuracy of job postings, recruitment practices, and employment offers, and any disputes arising from employment engagements must be settled directly between the job seeker and employer. FMLE and Sapphital shall not be held liable whatsoever, for the authenticity or otherwise of any job posting made by employers.
6. ACCEPTABLE USE
Users agree not to:
- Misuse the Portal for personal, political, or commercial gain outside job-related activities.
- Upload malicious content, spread misinformation, or harass other users.
- Attempt to gain unauthorized access to other users’ data or the Portal's backend.
- Use automated scripts, bots, or any unauthorized technology to manipulate or scrape data from the platform.
7. DATA PRIVACY & SECURITY
- All data collected shall be securely stored and processed according to Nigerian Data Protection laws.
- Personal information shall not be shared with third parties without user consent, unless legally required.
- FMLE and Sapphital shall not be held liable for any breach of data caused by third-party systems or force majeure events. Reasonable efforts shall be made to prevent and mitigate any such breach.
8. FEES AND SUBSCRIPTIONS
- Basic access to the Portal is free for all users.
- Employers may be charged for premium services such as job boosting, candidate filtering, or promotional listings.
- Fees will be clearly displayed before any transaction is completed.
- All payments made are final and non-refundable except where explicitly stated.
9. INTELLECTUAL PROPERTY
- The Portal and its contents, including logos, data, user interfaces, text, images, videos, and algorithms, are the intellectual property of FMLE and Sapphital Limited.
- Users may not copy, redistribute, alter, or exploit content from the Portal without prior written permission.
- Any content uploaded by users remains their intellectual property but grants FMLE and Sapphital a non-exclusive, royalty-free, global license to use, display, and distribute such content as required for platform operations.
10. TERMINATION AND SUSPENSION
- The Administrator reserves the right to suspend or terminate user accounts that violate these Terms or engage in suspicious, fraudulent, or unethical activity.
- Reinstatement of suspended accounts will be at the sole discretion of the Administrator.
- FMLE and Sapphital also reserve the right to restrict or remove access to any content or services deemed inappropriate, harmful, or in breach of Nigerian law or international labour standards.
11. LIABILITY DISCLAIMER
- FMLE and Sapphital shall not be liable for any direct, indirect, incidental, special, or consequential losses, damages, or injuries arising from the use of the Portal, including but not limited to missed employment opportunities, data loss, fraud, or technical issues.
- Job seekers are encouraged to verify job offers and conduct due diligence independently before accepting employment, as the Portal only facilitates initial connection and is not a guarantee of employment terms.
- Employers are solely responsible for the integrity and accuracy of job postings, recruitment practices, and employment offers, and any disputes arising from employment engagements must be settled directly between the job seeker and employer.
- Users are advised to exercise caution and discretion when interacting with unknown entities and report any suspicious activity to the Portal administrators promptly.
- The Portal and its administrators make no warranties or guarantees regarding job availability, employer responsiveness, or hiring outcomes.
- Under no circumstance shall FMLE or Sapphital be held responsible for losses arising from employer-employee disputes, salary disagreements, job offer withdrawals, or misconduct during interviews or onboarding.
12. MODIFICATION OF TERMS
FMLE reserves the right to modify these Terms at any time without prior notice. Significant changes will be communicated via the Portal or registered user emails. Continued use of the Portal after such changes constitutes acceptance of the revised Terms, which shall become binding upon the user's next visit or interaction with the platform.
13. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Disputes shall be resolved in the jurisdiction of competent courts in Nigeria.
